There are a number of ways to commence with divorce proceedings in Massachusetts. For example, if the parties agree on all of the terms of their divorce, then they may proceed with the assistance of their attorneys in the drafting of a divorce agreement and other required documents, and in obtaining a divorce in an uncontested manner. In such a case, they will ultimately need to agree upon such matters as child custody issues and child support amounts, if applicable; whether alimony will be paid and if so, for how long; who will carry health insurance for the parties and their minor children; asset and liability division, etc.. One of our primary roles in this regard would be to inform you thoroughly of the subject matters upon which you and your spouse must agree, and to provide you with insight and understanding as to what you should expect to receive as a result of the negotiations that take place regarding these subject matters.

There are many factors that determine how these subject matters should be resolved, including such things as the length of the marriage, the parties standard of living, contributions made by each party to the marital estate, each party’s employability and vocational skills and future expectancies, etc.. These factors are interrelated and an analysis of how they should affect the outcome of a divorce is often times very complex. Our role at The Law Offices of Joseph R. Leone is to provide you with an understanding of how all of these factors will influence the outcome of your particular divorce and to obtain successful results for you.

In the event that the parties are unable to agree upon all of the terms of their divorce, then at least initially, the matter must proceed in a contested fashion and a complaint for divorce will be filed by one party and served upon the other party. This begins the litigation process. Although a divorce matter may begin in a contested fashion, it may be converted to an uncontested divorce later on if the parties and their attorneys are able to negotiate an agreement on all of the terms of the divorce.
